7. Contract description
Overall objective is to remove the
technical barriers to international trade of chemicals by implementation of the
key EU Directives on Chemicals.
Through the implementation of these
Directives the submission of safe products to the market and
supply of international information exchange on the risk of chemicals have to
be ensured. Thus the project also aims at protecting the environment and human
health from the hazards of chemicals.
The specific objective of this
project will be to establish the necessary system, institutional structure, the
institutional capacity and the legal framework and to strengthen the regulatory
cycle for implementation of the two key EU Chemicals Directives in Turkey
(67/548/EEC and 1999/45/EEC Directives) and their two daughter Directives
(91/155/EEC and 93/67/EEC).

CONDITIONS OF PARTICIPATION
11. Eligibility
Participation
is open on equal terms to all natural and legal persons of the EU Member States
and Turkey, to natural and legal persons from EU candidate countries and the
countries benefiting from the financial and technical measures to accompany the
reform of economic and social structures in the framework of the
Euro-Mediterranean partnership (MEDA) and from the assistance for CARDS 1 Countries.
12. Candidature
All
eligible natural and legal persons (as per item 11 above) or groupings of such
persons (consortia) may apply.
A
consortium may be a permanent, legally-established grouping or a grouping which
has been constituted informally for a specific tender procedure. All members of a consortium (ie, the leader
and all other partners) are jointly and severally liable to the Contracting
Authority.
The
participation of an ineligible natural or legal person (as per item 11) will
result in the automatic exclusion of that person. In particular, if that ineligible person
belongs to a consortium, the whole consortium will be excluded.
13. Number of applications
No more
than one application can be submitted by a natural or legal person (including
legal persons within the same legal group), whatever the form of participation
(as an individual legal entity or as leader or partner of a consortium
submitting an application). In the event
that a natural or legal person (including legal persons within the same legal group)
submits more than one application, all applications in which that person (and
legal persons within the same legal group) has participated will be excluded.
14. Shortlist alliances prohibited
Any
tenders received from tenderers comprising firms other than those mentioned in
the short-listed application forms will be excluded from this restricted tender
procedure. Short-listed candidates may
not form alliances or subcontract to each other for the contract in question.
15. Grounds for exclusion
As part
of the application form, candidates must submit a statement to the effect that
they are not in any of the exclusion situations listed in Section 2.3.3 of the Practical Guide to contract
procedures financed from the General Budget of the European Communities in the
context of external actions (available from following Internet address: http://europa.eu.int/comm/europeaid/index_en.htm).

Sub-contracting
is allowed up to 30% of the contract amount.

On the
basis of the applications received, at least 4 and at most 8 candidates will be
invited to submit detailed tenders for this contract.

SELECTION AND AWARD
CRITERIA
21. Selection criteria
The
following selection criteria will be applied to candidates. In the case of applications submitted by a
consortium, these selection criteria will be applied to the consortium as a
whole:
1)
Economic and financial
standing of candidate
(a)
The average turnover of applicant (single applicant
or in case a consortium, consortium all members combined) must exceed 3 million
Euro, over the last two years (2003, 2004),
(b) The applicant (single
applicant or -in case of a consortium – all members combined) must have had a
positive cash and cash equivalents at the beginning and at the end of each year
over the last two years (2003-2004). In the case of non-profit organizations
bidding for the contract, they will have to demonstrate no loss in the last two
years.
2)
Professional capacity of
candidate
(c)
at least 10 staff currently work for the candidate (single applicant or the
whole consortium); and
(d)
at least 4 of all staff
working for the candidate (single applicant or the whole consortium) last year
(2004) in fields related to this contract are permanent.
3) Technical
capacity of candidate
(e) The candidate (single
applicant or consortium as a whole) must have practical experience of running
at least one technical assistance project similar to this project in
complexity, and nature - completed within the past three years.
If more
than 8 eligible candidates meet the above selection criteria, the relative
strengths and weaknesses of the applications of these candidates must be
reexamined to identify the eight best applications for the tender procedure. The only factors which will be taken into
consideration during this re-examination will be the comparison of the relative
depth of experience in the field related to this contract among candidates.
22. Award criteria
As
specified in the tender dossier annexed to the letter of invitation to tender
which will be sent to short-listed candidates.

Any
application received after this deadline will not be considered.
24. Application format and details to be

Applications must be submitted using the

instructions must be strictly observed.
Any application which does not observe these
provisions will be automatically eliminated. Any additional documentation (brochure,
letter, etc) sent with an application will not be taken into consideration.
