Following the modification
made to the PRAG rules by the EC on
Procurement

Article
9 “Tenderers must submit a statement to the effect that they are not in any
of the situations listed in point 2.3.3 of the Practical Guide to contracts
procedures financed by the general budget of the European Communities in the
context of external actions.”
Instructions
To Tenderers
i) Clause
11.11: Please revise this clause in accordance with the new Commission decisions
as follows:
“A statement to the effect
that they are not in any of the situations listed in section 2.3.3 of the
Practical Guide to contracts procedures financed by the general budget of the
European Communities in the context of external actions.”
ii) Clause
21: The following subsections are inserted in section 21:
21.6 The performance guarantee referred to in
the General Conditions is set at 10% of the amount of the contract and must be
presented in the form specified in the annex to the tender dossier. It will be
released within 30 days of the issue of the final acceptance certificate by the
Contracting Authority, except for the proportion assigned to after-sales service.”

remain unchanged. The above alterations and / or corrections to the tender

Form For A Supply Contract
Article
No.9: The
following paragraphs are added:
“In
the event that our tender is successful, we undertake to provide the proof
usual under the law of the country in which we are established that we do not
fall into the exclusion situations listed in section 2.3.3 of the Practical
Guide to contract procedures financed by the general budget of the European
Communities in the context of external actions. The date on the evidence or
documents provided will be no earlier than 180 days before the deadline for
submission of tenders and, in addition, we will provide a sworn statement that
our situation has not altered in the period which has elapsed since the
evidence in question was drawn up.
We also understand that if we fail to provide this
proof within 15 calendar days after receiving the notification of award, or if
the information provided is proved false, the award will be considered null and
void”
