CONTRACT SPECIFICATIONS

6. Description of the contract

The subject of the contract shall be the delivery, installation, putting into operation, training and warranty services by the Contractor of the various Specialised Biological Equipment and Inactivated Vaccine Against Rabies to the Central Veterinary Control and Research Institute located in Etlik, Ankara of the General Directorate of Protection and Control within the Ministry of Agriculture And Rural Affairs.

TERMS OF PARTICIPATION

8. Eligibility and rules of origin

Participation is open on equal terms to all natural and legal persons participating either individually or in a grouping (consortium) of tenderers of the Member States and Turkey, to natural and legal persons from the EU candidate countries and countries benefiting from the financial and technical measures to accompany (MEDA) the reform of economic and social structures in the framework of the Euro-Mediterranean partnership and from the assistance for Albania, Bosnia and Herzegovina, Croatia, the Former Yugoslav Republic of Macedonia, Serbia and Montenegro (CARDS). All goods supplied under this contract must originate in these countries[1].

9. Grounds for exclusion

Tenderers must submit a statement to the effect that they are not in any of the situations listed in point 2.3.3 of the Practical Guide to contracts procedures financed by the general budget of the European Communities in the context of external actions.

10. Number of tenders

Tenderers (including firms within the same legal group, other members of the same consortium, and sub-contractors) may submit only one tender. Tenders for parts of a lot will not be considered. Any tenderer may state in its tender that it would offer a discount in the event that its tender is accepted for more than one lot. Tenderers may not submit a tender for a variant solution in addition to their tender for the supplies required in the tender dossier.

11. Tender guarantee

Tenderers must provide a tender guarantee of 2% of the total offered value when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties. This guarantee will be called upon if the tenderer does not fulfil all obligations stated in its tender.

12. Performance guarantee

The successful tenderer will be asked to provide a performance guarantee of 10% of the amount of the contract at the signing of the contract. This guarantee must be provided no later than 30 days after the tenderer receives the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next best compliant tender.

Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.

SELECTION AND AWARD CRITERIA

16. Selection criteria

Minimum quality criteria for the tender are:

·         Economic and financial standing of the Tenderer(s) (firm or consortium): Average annual turnover presented in Euro[2] of the last 3 years (2001, 2002, 2003) shall be at least 2 (two) times the value offered.

·         Technical capacity of the Tenderer(s): The Tenderer or its representative must have a Service Facility Sufficiency Certificate issued by relevant authorities, which must clearly specify that they are authorized to service the manufacture equipment. The Tenderer must also prove that the Tenderer or the manufacturer or their authorized representatives are authorized to deliver the service in Turkey, and it is available in the delivery points.

·         Conformity with formal, administrative and technical requirements of the Tender Dossier.

17. Award criteria

The cheapest technically compliant price.

The Contracting Authority must reply to all tenderers' questions at least 11 days before the deadline for submission of tenders. The replies will be published on the following Internet address:

The prospective tenderer obtaining the tender dossier from the Europe Aid web-site should advise the CFCU, so that any changes to the tender dossier may be communicated to them.

19. Deadline for submission of tenders

Tenders must be received at the offices of CFCU before 11 October 2004 at 12.00 hrs local time.

Any tender received after this deadline will not be considered.
