7. Contract description
The main aim of the project is to enhance the
institutional capacity of the Financial Crimes Investigation Board (MASAK). A
technical assistance team specialised in IT consulting in the creation of a
Management Information System (Central Database) is expected to:
·
Support MASAK in supervision and monitoring of the
procurement of IT equipments, software-operating system, database, application
tools, application development-training and all other necessary services afterwards,
ensure the quality of the services provided as well as the proper execution of
the project.
·
Analyse the kind of issues that may arise after the
amendment of Anti-Money Laundering (AML) legislation.
·
Support MASAK in carrying out the acceptance test and
control services for the goods and services which will be delivered within the
supply component of the project to determine whether goods and services comply
with the technical specifications.
·
Provide the labelling and listing the serial numbers
of all goods within the supply component of the project which are inspected and
tested together with inspection of software licences and other relevant
technical documents.
·
Design and provide necessary training for both experts and
IT staffs of Financial Crimes Investigation Board on Analytical Investigation
Methods, Basic Elements of Criminal Intelligence(Analysis of criminal
intelligence, crime, data, criminal investigative and concealed income; crime
analysis applications, analytical process, link analysis analytical charting,
law enforcement research and statistical methods) and Java ( Technology for Structured Programmers, Programming Language,
Implementing Java Security, Messaging, Web Component Development Using Java
Technology, Managing XML with the Java Platform, Data Structures in Java,
Object-Oriented Application Analysis and Design for Java Technology(UML),
Design Patterns, XML, Architecting and Designing J2EE Applications), Software
Development (Business Analysis, User application requirement analysis
(UML)(based on use cases and business), Object Oriented Design (UML), Object
Orientation, Test Design (based on use cases), System Development life cycle
15288, Software Development life cycle 12207), Networking (Introduction to
LAN/WAN, Introduction to TCP/IP Introduction to SNMP, Introduction to UNIX,
Unix and Networking, ITIL BS15000) ,E-Security (Information Security Concepts,
Essentials ,Managing information security ISO 17799, Securing Web Services and
Applications, Cryptology ,VPN’s and Cryptanalysis)
respectively.

Support MASAK in ensuring the required IT
infrastructure together with the necessary tools established to enable a successful
exchange of information between the institutions such as Ministry of Finance,
Ministry of Interior, Ministry of Justice, Public and other relevant law
enforcement and financial institutions-commercial banks, economic partners-etc.
·
Ensure the planning and coordination of the trainings
that will be provided by the supply consultant.
·
Prepare an Institutional Security Policy fully
compliant with ISO 17799:2000 and independent from application platform.
·
Provide security awareness training programs in three
different level such as management level, user level and operator level for
MASAK staff.

CONDITIONS OF PARTICIPATION
11. Eligibility
Participation is open on equal terms to all natural and legal persons of
the EU Member States and Turkey, to natural and legal persons from the
PHARE candidate countries and from countries benefiting from the financial and
technical measures to accompany the reform of economic and social structures in
the framework of the Euro-Mediterranean partnership (MEDA) and from the
assistance for Albania, Bosnia and Herzegovina, Croatia, the Federal Republic
of Yugoslavia and the former Yugoslav Republic of Macedonia (CARDS).
12. Candidature
All eligible natural and legal persons (as per item 11 above) or
groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally-established grouping or a
grouping which has been constituted informally for a specific tender
procedure. All members of a consortium (ie, the leader and all other partners) are jointly and
severally liable to the Contracting Authority.
The participation of an ineligible natural or legal person (as per item
11) will result in the automatic exclusion of that person. In particular, if that ineligible person
belongs to a consortium, the whole consortium will be excluded.
13. Number of applications
No more than one application can be submitted by a natural or legal
person (including legal persons within the same legal group), whatever the form
of participation (as an individual legal entity or as leader or partner of a
consortium submitting an application).
In the event that a natural or legal person (including legal persons
within the same legal group) submits more than one application, all
applications in which that person (and legal persons within the same legal
group) has participated will be excluded.
14. Shortlist alliances prohibited
Any tenders received from tenderers comprising
firms other than those mentioned in the short-listed application forms will be
excluded from this restricted tender procedure.
Short-listed candidates may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion
As part of the application form, candidates must submit a statement to
the effect that they are not in any of the exclusion situations listed in
Section 2.3.3 of the Practical Guide to
contract procedures financed from the General Budget of the European Communities
in the context of external actions (available from following Internet address: http://europa.eu.int/comm/europeaid/index_en.htm).
16. Sub-contracting
The maximum
percentage that may be subcontracted is 30% of the contract value.
17. Number of candidates to be short-listed
On the basis of the applications received, at least 4 and at most 8
candidates will be invited to submit detailed tenders for this contract.

SELECTION AND AWARD CRITERIA
21. Selection criteria
The following selection criteria will be applied to candidates. In the case of applications submitted by a
consortium, these selection criteria will be applied to the consortium as a
whole:
1) Economic and financial standing
of candidate [based on item 3 of the
application form]
The average annual
turnover of candidate (single candidate or in case a consortium, consortium
members combined) must exceed 1.5
million, over the last 2 years (2002, 2003)
The Averages of Cash and Cash
Equivalents (single
applicant or the total of the whole consortium) at the beginning and end of
each of the last three years, current year included (estimate) are positive.
2) Professional capacity of
candidate [based on items 4 and 5 of the
application form]
The candidate (single applicant or the total of the whole consortium)
shall have at least 5 permanent staff currently working in fields related to
this contract.
3) Technical capacity of candidate [based on items 5 and 6 of the application
form]
The candidate (single applicant or the consortium as a whole) has worked
successfully
on at least two major projects on which the candidate (single applicant or the
consortium as a whole) has worked successfully with a budget of at least that
of this contract related to IT Technical Assistance in the field of money
laundering in the past three years.
If more than 8 eligible candidates meet the above selection criteria, the
relative strengths and weaknesses of the applications of these candidates must
be re-examined to identify the eight best applications for the tender
procedure.
The only factor which will be taken
into consideration during this re-examination is the number of the project on
which the candidate has worked successfully with a budget of at least that of
this contract related to IT technical assistance in the field of money
laundering in the past three years.
22. Award criteria
As specified in the tender dossier annexed to the letter of invitation
to tender which will be sent to short-listed candidates.

23. Deadline for receipt of
applications
Any application received by the CFCU after this
deadline will not be considered.
24. Application format and details to be provided
Applications must be submitted using the standard application form (available from the following Internet address: http://europa.eu.int/comm/europeaid/index_en.htm), whose format and instructions must be strictly
observed.
Any application which does not observe these provisions will be
automatically eliminated. Any additional documentation (brochure, letter, etc) sent with an
application will not be taken into consideration.

The Contract title and the Publication
reference (see item 1 above) must be clearly marked on the envelope
containing the application and must always be mentioned in all subsequent
correspondence with the Contracting Authority.
Applications submitted by any other means will not be considered.
26. Operational language
All written communications for this tender procedure
and contract must be in English.
27. Additional information
The
implementation of the contract is currently set at 15 months providing that an
extension of the disbursement deadline is granted. Otherwise all activities
under the contract should end by the 30 th
September 2005.
