CONTRACT SPECIFICATIONS

6. Description of the contract

The subject of the tender is the supply, delivery, installation, putting into operation, testing, calibration of general, biological, chemistry and vaccine production laboratory equipment including training and warranty services for the three control and research institutes and the FMD institute of the Ministry of Agriculture And Rural Affairs located in İstanbul, Ankara, İzmir DDP (Delivered Duty Paid) final destination.

7. Number and titles of lots

Four Lots:

Lot 1:    General laboratory equipment

Lot 2:    Specialised biological equipment

Lot 3:    Specialised chemistry equipment

Lot 4:    Vaccine production equipment

 

TERMS OF PARTICIPATION

8. Eligibility and rules of origin

Participation is open on equal terms to all natural and legal persons participating either individually or in a grouping (consortium) of tenderers of the Member States and Turkey, to natural and legal persons from the PHARE candidate countries and from countries benefiting from the financial and technical measures to accompany (MEDA) the reform of economic and social structures in the framework of the Euro-Mediterranean partnership and from the assistance for Albania, Bosnia and Herzegovina, Croatia, the Federal Republic of Yugoslavia and the former Yugoslav Republic of Macedonia (CARDS). All goods provided for this contract must originate in these countries.

9. Grounds for exclusion

Tenderers must provide documentary proof[1] that they are not in any of the situations listed in point 2.3.3 of the Practical Guide to contracts procedures financed by the general budget of the European Communities in the context of external actions.

10. Number of tenders

Tenderers (including firms within the same legal group, other members of the same consortium, and sub-contractors) may submit tender(s) for one or more lots. Tenders for parts of a lot will not be considered. Any tenderer may state in its tender that it would offer a discount in the event that its tender is accepted for more than one lot. Tenderers may not submit a tender for a variant solution in addition to their tender for the supplies required in the tender dossier.

11. Tender guarantee

Tenderers must provide a tender guarantee in Euro for affixed amount corresponding to 2% of the budget offered in the proposal when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties. This guarantee will be called upon if the tenderer does not fulfil all obligations stated in its tender.

12. Performance guarantee

The successful tenderer will be asked to provide a performance guarantee of 10% of the amount of the contract in Euro at the signing of the contract. This guarantee must be provided no later than 30 days after the tenderer receives the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next best compliant tender.

No information meeting or site visit is planned

14. Tender validity

Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.

15. Period of execution

90 (ninety) calendar days after the signature of contract.

 


SELECTION AND AWARD CRITERIA

16. Selection criteria

                   Minimum quality criteria for the tender are:

·         Economic and financial standing of the Tenderer(s) (firm or consortium):

a)        Average annual turnover of the last 3 years (Euro)[2] shall be at least 3 (three) times the value offered for the lot(s).

b)        The annual quick ratio of the tenderer for the last year, and the average of last three years have to be at least 0,9[3].

The Tenderer(s) must prove economic and financial capacity by furnishing audited annual financial statements of financial positions and overall turnover during a period for the last three years.

·         Technical capacity of the Tenderer(s) (firm or consortium):

a)         At least three (3) contracts/projects where the Tenderer has provided similar equipment value and complexity  to those for which it is bidding in this Tender during the last three (3) years.

            The Tenderer(s) must submit a list of the principal supplies delivered in the past three years, with the sums, dates and recipients, public or private; where the supplies and the relevant service were provided to Contracting Authorities, and evidence of performance which takes the form of certificates issued or countersigned by the competent authority.

b)         Manufacturer must be ISO 9002 certified. The Tenderer or its representative must have a Service Facility Sufficiency Certificate issued by relevant authorities, which must clearly specify that they are authorized to service the manufacture equipment. The Tenderer must also prove that the Tenderer or the manufacturer or their authorized representatives are authorized to deliver the service in Turkey, and it is available in the delivery points.

·         The administrative and technical criteria as stipulated in the tender dossier.

17. Award criteria

The lowest technically compliant price.

Any prospective tenderer obtaining the tender dossier from the Europeaid website should advise the CFCU so that any changes to the tender dossier may be communicated to them. The tender dossier is also available for collection from the Contracting Authority. Tenders must be submitted using the standard tender form included in the tender dossier, whose format and instructions must be strictly observed.

21. Legal basis

Council Regulation Nr. (EC) 2500/2001 of 17 December 2001 concerning pre-accession financial assistance for Turkey and amending regulations (EEC) No. 3906/89, (EC) No. 1267/1999, EC) No. 1268/1999 and EC No 555/2000.

22. Suspension Clause

Award of this contract is subject to satisfaction, by the Beneficiary, of the following conditions before this contract is signed:

                                            I.      The laboratories must be in good structural condition and must have adequate space for installation and operation of the equipment and for carrying out the necessary techniques.

                                         II.      There must be adequate and satisfactory supplies of services, including, where appropriate, electricity, water, drainage and gas with sufficient and approximately located outlet points.

                                       III.      There must be adequate and appropriate ventilation and temperature controls, including air conditioning where necessary, to provide a suitable working environment.

                                      IV.      Conditions must be suitable to protect staff from noxious materials including chemicals and biological agents.

A specific report (including relevant plans and descriptions) prepared by the project beneficiary and certifying that the above conditionality is met shall be submitted to the EC-Representation and to the CFCU for verification before supply contract signatures.



[1] Please, note that sworn statements submitted by Tenderers to declare that they do not fall under the situations listed in Article 2.3.3 of the Practical Guide are not sufficient. Tenderers have to prove that they do not fall under the situations listed in Article 2.3.3 of the Practical Guide by providing the necessary documentation to be issued in accordance with the relevant National legislation.
